Hands on Concepts Limited Lifetime Frame Workmanship Warranty

This written limited warranty covers specified HOC frame workmanship and separately identifies coverage for other HOC and third-party components.
1. Warranty Provider and Covered Purchaser
This warranty is provided by Hands on Concepts 3 Inc. to the original retail purchaser of a covered HOC product. Proof of purchase, Build or serial information, and reasonable proof of original-purchaser status may be required. This warranty is not transferable unless mandatory law requires otherwise or HOC agrees in writing.
2. Limited Lifetime Frame Workmanship Coverage
For the reasonable useful life of the original HOC frame, HOC warrants that the covered frame will be free from defects in HOC craftsmanship under normal use and proper maintenance. "Lifetime" means the reasonable useful life of the original frame, not the life of the purchaser and not an unlimited period regardless of condition, wear, service history, or product obsolescence.
Covered frame workmanship includes HOC-manufactured frame tubes and welds, HOC carbon-fiber frame components, folding mechanisms, caster housings, back posts, and footrest structures when failure results from defective HOC craftsmanship. Screws, bolts, bearings, upholstery, finishes, tires, wheels, brakes, cushions, accessories, electronics, batteries, and other replaceable or wear components are not lifetime frame components unless HOC expressly identifies them in writing.
3. Other HOC Components
HOC warrants other HOC-manufactured components against defects in HOC materials and workmanship for one year after delivery, unless a longer written period accompanies the component or mandatory law requires more. Normal maintenance and wear items are not covered merely because they require replacement during that period.
4. Finishes and Cerakote
HOC warrants the initial application of an HOC-applied finish against a defect in workmanship for one year after delivery. Normal cosmetic wear, scratches, chips, impact damage, fading, abrasion, corrosion caused by exposure or neglected cleaning, color variation, and damage from chemicals, salt, sand, adhesives, tools, or unauthorized refinishing are excluded unless law requires coverage.
5. Third-Party Products
Third-party wheels, tires, bearings, seating, backs, cushions, brakes, electronics, batteries, chargers, accessories, and other components are ordinarily covered by the respective manufacturer's warranty. When HOC supplied the item, HOC will reasonably help the purchaser identify and submit a manufacturer claim. This allocation does not eliminate any direct seller responsibility, implied warranty, conformity remedy, or other right that applicable law imposes on HOC.
6. Exclusions Requiring a Causal Connection
To the extent permitted by law, this warranty does not cover a condition caused by accident, collision, abuse, misuse, neglect, unreasonable use, use beyond disclosed limits, failure to inspect or maintain, improper storage, corrosion or contamination, fire or flood, incompatible parts, improper installation or service, structural alteration, welding, drilling, bending, grinding, heating, or another modification.
Independent service, a non-HOC part, or a modification does not automatically void the entire warranty. HOC may deny coverage only to the extent the claimed condition was caused by an excluded act, incompatible part, improper service, or modification, as allowed by law.
7. Maintenance Conditions
The owner should perform pre-use safety checks, inspect and clean bearings at least monthly or more often in harsh conditions, and check fastener torque at least every three months using applicable HOC and component instructions. Tires, brakes, axles, casters, upholstery, seating, anti-tips, and accessories must be maintained and adjusted. Stop use when cracking, looseness, instability, unusual motion or sound, brake failure, or another unsafe condition appears.
Failure to maintain does not erase unrelated coverage. HOC may deny only a condition or additional damage actually caused by unreasonable maintenance failure, to the extent allowed by law.
8. Claim Procedure

Provide the purchaser name, Build or serial number, proof of purchase, delivery date, a clear description, safe photographs or video, maintenance and incident information, and current contact details. HOC may request remote troubleshooting, inspection, return of a component, or shipment to an authorized service location. Do not ship a complete wheelchair or hazardous battery without written instructions.
9. Remedies
For a covered claim, HOC will, at its option and subject to law, repair the product, replace the affected component with a new or functionally equivalent component, replace the product, or refund the applicable purchase amount. A replacement may differ cosmetically or use a current equivalent when the original component is unavailable. The remedy will be provided within a reasonable time.
If a limited remedy fails of its essential purpose, or if applicable law requires another remedy after repair attempts or delay, the purchaser retains the remedy required by law.
10. Freight, Labor, and International Service
HOC pays reasonable authorized parts, labor, and transportation costs for covered HOC-workmanship claims when required by this warranty or law. For a noncovered claim, the purchaser is responsible for approved diagnostic, freight, customs, travel, and repair charges disclosed before work. Worldwide claims may require return to California or another location HOC designates. The purchaser should not incur costs expecting reimbursement without authorization, except where emergency or mandatory law makes preauthorization unreasonable.
HOC does not promise a loaner or temporary wheelchair under this voluntary warranty. A temporary replacement will be provided when mandatory law requires one.
11. Implied Warranties and Mandatory Rights
This is a limited warranty. HOC does not disclaim an implied warranty or statutory right that cannot lawfully be disclaimed. Where law permits a duration limit on implied warranties, any limit must be separately and validly disclosed; this warranty does not impose one. Some jurisdictions provide rights in addition to this warranty, including fit, conformity, repair, replacement, price reduction, rescission, or refund rights.
12. California Wheelchair and Assistive-Device Rights
California law may require a separate written express warranty of at least one year for a new wheelchair and may provide a statutory assistive-device fit warranty and remedies. HOC must deliver the required California document in the required format at sale. This voluntary warranty supplements and does not replace or waive those rights.
13. Limitation of Damages
To the extent permitted by law, HOC is not responsible under this warranty for indirect or consequential commercial loss. This limitation does not apply to personal injury, fraud, willful misconduct, product-liability obligations, a statutory remedy, or another liability that cannot be limited. Some jurisdictions do not permit these limitations.
14. Effective Scope
This version applies only to products purchased on or after its effective date. Earlier products remain governed by the warranty delivered with the sale and mandatory law. HOC may improve future warranty terms but will not retroactively reduce an accepted warranty.
