Regional Consumer and Privacy Addendum

This addendum summarizes additional regional principles. It does not replace mandatory local law and must be reviewed for every country in which HOC actively markets or maintains a local establishment.

1. General Rule

The Terms choose California law and San Diego County courts only to the extent permitted. A consumer keeps mandatory protections of the consumer's habitual residence, including product conformity, cancellation, warranty, privacy, accessibility, and court-access rights.

2. California and Other United States Jurisdictions

California purchasers may have specific wheelchair defect and assistive-device fit-warranty rights. HOC must deliver the required separate statutory notice and warranty at sale. State privacy rights, including access, correction, deletion, opt-out, limitation, and appeal rights, apply when statutory coverage and exceptions are met. HOC states it does not sell personal information or share it for targeted advertising.

Washington and other consumer-health laws may apply to measurements and fitting information. The separate Consumer Health Data Privacy Policy governs those activities and must be linked conspicuously.

3. European Economic Area and United Kingdom

Consumers retain mandatory conformity remedies and eligible distance-sale withdrawal rights, subject to the bespoke-goods exception. Health and disability information may be special-category data and requires both an ordinary lawful basis and a valid special-category condition. HOC must document international-transfer safeguards and determine whether an EU or UK representative or data-protection officer is legally required before targeted expansion.

4. Canada

HOC will apply accountability, identified purposes, meaningful consent, collection limitation, safeguards, openness, access, and correction principles where Canadian private-sector privacy law applies. Provincial consumer, privacy, accessibility, health-information, and warranty law may add obligations.

5. Australia and New Zealand

Mandatory consumer guarantees cannot be excluded. Privacy, direct-marketing, overseas-disclosure, access, correction, and breach-notification rules may apply. HOC will not describe a voluntary warranty as replacing a consumer guarantee.

6. Other Countries

Import licenses, local labeling, product registration, tax, customs, sanctions, accessibility, data-localization, representative, withdrawal, warranty, and dispute rules vary. HOC may decline a destination until compliance is confirmed. A translated policy is provided for convenience unless mandatory law requires the translation to control.

7. Complaints and Regulators

Individuals may contact HOC first but retain the right to complain to a consumer, privacy, health-data, accessibility, product-safety, or other competent authority. HOC will not retaliate for a good-faith complaint.
